Terms of service
TERMS OF SERVICE
Effective 8 September 2026
These Terms of Service govern your use of the WHITECAT online store and any purchase you make through the store. By placing an order through the store, you agree to these Terms of Service, together with our Return & Refund Policy, Shipping Policy and Privacy Policy. These Terms do not exclude or limit any rights you have under the Australian Consumer Law.
1. About WHITECAT
The online store is operated by White Cat Co Pty Ltd trading as WHITECAT, ABN 67 602 922 314.
Contact: 0413 935 656 | info@whitecat.com.au
Customer service hours are Monday to Friday, 9:00 am to 5:00 pm AEST, excluding Australian public holidays, unless otherwise stated.
2. Eligibility and Use of the Store
You must provide accurate and complete information when placing an order or creating an account. You are responsible for keeping your account and login information secure.
You must not use the store for unlawful purposes, attempt to interfere with the operation or security of the store, or submit information that is false, misleading or fraudulent.
3. Products and Product Information
We take reasonable care to ensure that product descriptions, images, specifications, prices and availability displayed in the store are accurate. Product colours and appearance may vary depending on your device or display.
Manufacturers may change product specifications, packaging or availability. Where a material change affects an accepted order and the original product cannot reasonably be supplied, we will contact you to discuss an appropriate alternative or other resolution.
Where a product is intended for professional, clinical, sterilisation or other regulated use, you are responsible for using it in accordance with the applicable manufacturer instructions, IFU, warnings and intended purpose.
4. Orders and Acceptance
When you place an order, you are making an offer to purchase the products in your cart. An automated order confirmation acknowledges receipt of your order but does not necessarily constitute acceptance.
An order is accepted when we confirm acceptance, dispatch the goods, or otherwise communicate acceptance to you.
We may decline or cancel an order before acceptance where, for example, a product is unavailable, a pricing or listing error has occurred, we reasonably suspect fraud, or we are unable to fulfil the order. If payment has already been taken for an order that we cancel, we will refund the amount paid.
Nothing in this clause limits your rights under the Australian Consumer Law.
5. Prices, GST and Payment
· All prices are in Australian dollars unless otherwise stated.
· Prices include GST where applicable unless expressly stated otherwise.
· Delivery and other applicable charges are displayed at checkout or otherwise disclosed before you complete your purchase.
· We may correct an obvious pricing or clerical error before dispatch. If this occurs, we will contact you and give you the option to proceed at the corrected price or cancel the order.
· Payment must be completed using a payment method offered through the store.
6. Delivery
We will provide the delivery options and estimated delivery timeframe available for your order at checkout or in our Shipping Policy. Delivery timeframes are estimates unless we expressly agree otherwise.
If an order is not delivered within a reasonable time, you may have rights under the Australian Consumer Law. If we cannot supply products you have paid for, we will provide an appropriate resolution in accordance with applicable law.
You are responsible for providing an accurate delivery address. If an order cannot be delivered because the address supplied is incorrect or incomplete, additional delivery costs may apply where permitted by law.
7. Returns, Refunds and Consumer Guarantees
Our Return & Refund Policy explains the process for change-of-mind returns and returns for faulty, damaged, incorrect or non-compliant products.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms of Service, our Return & Refund Policy or any other store policy is intended to exclude, restrict or modify a right or remedy that cannot lawfully be excluded, restricted or modified.
8. Change-of-Mind Returns
We may accept eligible change-of-mind returns in accordance with our Return & Refund Policy. A change-of-mind return is different from a return because a product has a problem.
Any conditions, exclusions, restocking fee or return-freight arrangements applying to change-of-mind returns do not limit your rights under the Australian Consumer Law.
9. Product Safety, Clinical and Sterile Products
For health, safety, sterility and traceability reasons, certain products may not be eligible for change-of-mind returns once opened, used or otherwise made unsuitable for resale.
Products that have been used in patient treatment or clinical care may also be excluded from change-of-mind returns.
These restrictions do not apply to the extent that you have a statutory right to a remedy because the product does not comply with a consumer guarantee or other applicable law.
10. Accounts and Customer Information
If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
We may suspend or close an account where reasonably necessary for security, fraud prevention, unlawful activity or material breach of these Terms, subject to applicable law and any rights you may have.
11. Website Content and Intellectual Property
The WHITECAT website, including its branding, logos, product content, text, photographs, graphics, design and other materials, is owned by or licensed to WHITECAT and is protected by applicable intellectual property laws.
You may access and use the website for personal or legitimate business purchasing purposes. You must not reproduce, modify, distribute, scrape, republish or commercially exploit WHITECAT content without our prior written permission, except where permitted by law.
12. Reviews and User Content
If the store allows you to submit reviews, comments, photographs or other content, you must ensure that the content is accurate, lawful and does not infringe another person's rights.
By submitting content, you grant WHITECAT a non-exclusive, royalty-free licence to use, reproduce and display that content for operating and promoting the store, subject to applicable privacy laws.
We may remove content that is unlawful, misleading, abusive, defamatory, discriminatory, fraudulent or otherwise inappropriate. This does not affect any rights you have under applicable law.
13. Third-Party Services and Links
The store may contain links to third-party websites or use third-party services such as payment providers, delivery providers or technology platforms. Those third parties may have their own terms and privacy policies.
WHITECAT is not responsible for third-party websites or services to the extent permitted by law, but this does not limit any rights or remedies that cannot lawfully be excluded.
14. Privacy
We collect, use and disclose personal information in accordance with our Privacy Policy and applicable privacy laws.
Payment information may be processed by third-party payment providers. We do not intend to retain complete payment-card details where the payment provider processes those details on our behalf.
15. Website Availability and Errors
We aim to keep the store available and accurate, but we do not guarantee that the website will always be uninterrupted, error-free or free from technical issues.
We may temporarily suspend access for maintenance, security, upgrades or circumstances outside our reasonable control.
Nothing in this clause limits any guarantee or right that cannot lawfully be excluded.
16. Liability
To the maximum extent permitted by law, WHITECAT is not liable for loss or damage caused by matters outside our reasonable control or by a customer's misuse of products, failure to follow applicable instructions, or unauthorised modification of products.
Where the Australian Consumer Law or another law imposes liability that cannot be excluded or limited, that liability remains unaffected.
Where the law permits a limitation of liability for goods or services not ordinarily acquired for personal, domestic or household use, WHITECAT may rely on the applicable statutory limitation to the extent permitted by law.
17. Events Outside Our Reasonable Control
We are not responsible for delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, transport disruption, industrial action, government action, supply-chain disruption, manufacturer shortages, cyber incidents affecting critical infrastructure, or other force majeure events.
We will take reasonable steps to communicate material delays and, where appropriate, discuss an alternative supply or cancellation arrangement.
18. Changes to These Terms
We may update these Terms of Service from time to time. The version applying to an order is the version in effect when the order is accepted, unless a change is required by law.
Changes to these Terms will not retrospectively remove rights or remedies that you have already acquired.
19. Governing Law
These Terms of Service are governed by the laws of Victoria, Australia. Subject to any mandatory rights you may have under applicable law, the courts of Victoria have jurisdiction over disputes relating to these Terms or purchases made through the store.
